In Singapore, the law under the Women’s Charter adopts a general policy of minimal intervention. Where a marriage has turned sour, laws of separation and divorce offer relief to both parties in a marriage. Separation is temporary, whilst divorce is permanent. Thus, a divorce occurs when there is a fundamental breakdown in the relationship between husband and wife.


The Family Court in Singapore primary purpose to resolve disputes in the most harmonious avenue possible. The reason for the emphasis on harmonious dispute resolution is for the parties to resume their respective roles in the family after the disputes have been resolved. In order to facilitate this, the Family Court has offered key alternative processes to litigation — mediation and counselling — in order to facilitate the harmonious and peaceful resolution of disputes. Under the Women’s Charter, s. 50(1), a court, with the view of resolving disputes harmoniously, may refer the parties for divorce mediation. This section seeks to briefly explain what such family mediation in a divorce is about.


Under the Women’s Charter, a divorce is seen as a “relief of last resort”, where the relationship is irretrievably broken down.

In general, the difference between a “contested” divorce and “uncontested” divorce, is that the former occurs where either one or both parties recognize that their relationship has broken down irretrievably, but are unable to accept the allegations on the grounds of divorce leveled by the other party.


Divorce is emotionally stressful for all parties involved. Traditionally, contested divorce proceedings primarily involve litigation in court. Today, however, the law provides for two alternative routes (i.e. “Court-based Family Mediation” and “Private Family Mediation“) to resolve disputes arising from divorce via mediation.
